Terms and conditions

  

Terms and Conditions – Memberships and Gym

Recreate is a trading style of Recreate Holdings Ltd.

By joining Recreate, you agree to the following terms and conditions.

1. Membership Selection

  • You      are required to choose a membership option before the end of your initial      month.
  • A      team member will assist you in selecting the most appropriate membership.

2. Membership Fees and Payment

  • Membership      fees are charged monthly on a continuous basis unless a concession has      been agreed at the point of sale for a specified period.
  • All      memberships operate on an auto-renewing 12-month term, starting after your      initial 30-day cooling-off period.
  • Membership      fees are collected by recurring card payment, as provided during      registration or review.
  • Payments      are taken on the 1st of each month.
  • If      your membership begins on any other date, a pro rata payment will      be taken for the remainder of that month.
  • You      are responsible for paying the full membership fee for the agreed term,      regardless of attendance or usage.

Recreate reserves the right to adjust membership fees in line with inflation and industry standards.

3. Cooling-Off Period

  • You      are entitled to a 14-day cooling-off period from the date of your      sign-up appointment.
  • If      you wish to cancel within this period, please contact Recreate immediately      on 01733 300074.
  • If      termination notice is not provided before the first payment or within the      first 30 days, you will enter into the 12-month commitment (or agreed      rolling monthly fee).

4. Acceptance of Membership

  • Acceptance      of any membership application is at the sole discretion of Recreate.
  • We      reserve the right to verify any information provided.
  • Membership      commences on the earlier of:
    • The       date of this agreement, or
    • Receipt       of your first membership payment.
  • Acceptance      of your application forms a legally binding contract.
  • By      joining, you agree to these terms and the full terms and conditions      available online.
  • Recreate      may terminate this agreement after the initial period by providing 30      days’ written or email notice.
  • Membership      fees are non-refundable if you choose not to attend sessions.

5. Sessions and Cancellations

  • All      sessions are arranged by scheduled appointment.
  • A      minimum of 8 hours’ notice is required to cancel or reschedule a      session.
  • Cancellations      must be made via the Recreate Coach app.
  • Sessions      cancelled within 8 hours of the scheduled time will be deducted from your      account unless a valid reason is provided to the office before the session      begins.

6. Ending Your Membership

During the Initial 12-Month Term

  • You      may request to cancel at any time; however, you remain liable for the full      12-month membership investment.
  • All      agreed payments must continue until the full term has been completed.
  • Recreate      operates a strict no-refund policy.

After the Initial 12-Month Term

  • You      may cancel your membership by providing at least 30 days’ written      notice (email or letter).
  • Notice      will take effect after the expiry of the initial 12-month term.
  • You      must continue to pay membership fees during the 30-day notice period.
  • Your      membership will end on the last day of the month following completion of      the 30-day notice period.
  • Notice      is only valid once received by Recreate. We recommend obtaining proof of      delivery.

7. General

  • All      membership terms apply unless otherwise confirmed in writing.
  • Full      terms and conditions are available online.

Personal Training Terms & Conditions

(Applicable to One-to-One and Group Training Sessions)

1. Definitions

“PT” refers to the Personal Trainer and/or Recreate Team.

“Client” refers to any individual participating in one-to-one or group Personal Training sessions.

“Sessions” refers to all personal training services provided, including one-to-one, small group, group classes, programmes, and related coaching services.

2. Health & Medical Declaration

2.1 The Client confirms they are medically fit to participate in physical exercise and have disclosed all relevant medical conditions, injuries, medications, or health concerns prior to commencing Sessions.

2.2 The Client agrees to complete a Physical Activity Readiness Questionnaire (PAR-Q) or equivalent health screening form before participating.

2.3 The Client must immediately inform the PT of:

  • Any      pain, discomfort, dizziness, or unusual symptoms during a Session.
  • Any      change in medical condition.
  • Any      injury sustained outside of Sessions that may affect participation.

2.4 The PT reserves the right to refuse or suspend participation if there are reasonable concerns regarding the Client’s health or safety.

3. Assumption of Risk

3.1 The Client acknowledges that participation in one-to-one and group exercise activities involves inherent risks, including but not limited to:

  • Muscular      strain, sprains, or tears
  • Slips,      trips, or falls
  • Cardiovascular      events
  • Aggravation      of pre-existing conditions

3.2 In group Sessions, the Client acknowledges that:

  • Exercise      intensity may vary between participants.
  • The      PT may not be able to provide constant one-to-one supervision.
  • The      Client is responsible for exercising within their own limits.

3.3 The Client voluntarily assumes all risks associated with participation and agrees that they participate at their own risk.

4. Limitation of Liability

4.1 Nothing in these Terms & Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded under UK law.

4.2 Subject to clause 4.1, the PT shall not be liable for:

  • Injury      resulting from failure to disclose relevant medical information.
  • Injury      occurring outside supervised Sessions.
  • Injury      caused by the Client’s failure to follow instructions.
  • Injury      arising from participation in group Sessions where exercises are      self-paced.
  • Indirect,      incidental, or consequential loss.

4.3 To the fullest extent permitted by law, the PT’s total liability arising out of or in connection with any claim shall not exceed the total fees paid by the Client for the specific Session(s) giving rise to the claim.

5. Insurance

5.1 The PT confirms that appropriate and valid insurance policies are maintained, including:

  • Public      Liability Insurance
  • Professional      Indemnity Insurance
  • Employers’      Liability Insurance (where applicable)

5.2 Evidence of current insurance cover is available upon reasonable request.

6. Bookings, Attendance & Cancellations

6.1 All Sessions must be booked in advance and are subject to availability.

6.2 For one-to-one Sessions, a minimum of 24 hours’ notice is required to cancel or reschedule. Failure to provide sufficient notice may result in the Session being charged in full.

6.3 For group Sessions:

  • Missed      Sessions are non-transferable unless otherwise agreed.
  • No      refunds or credits will be issued for non-attendance unless agreed in      writing.

6.4 If the PT cancels a Session, it will be rescheduled or credited at no additional cost.

7. Refund Policy

7.1 Refunds are not provided for unused Sessions except at management discretion or where required by law.

7.2 If a Client wishes to make a claim for a refund for any reason — including non-attendance, whether due to the Client’s fault or the PT’s fault — the claim must:

  • Be      made in writing
  • Be      sent to admin@recreateteam.com
  • Be      submitted no later than 14 days from the date of the incident

7.3 Refund claims submitted more than 14 days after the incident will not be considered and will not be backdated under any circumstances.

7.4 Approved refunds (if any) will be processed within 14 working days.

8. Payment Terms

8.1 All Sessions must be paid for in advance unless otherwise agreed in writing.

8.2 Block bookings and packages may have expiry dates, which will be confirmed at purchase. Unused Sessions beyond the expiry date may be forfeited.

8.3 Payments are non-transferable unless agreed in writing.

9. Code of Conduct

9.1 The Client agrees to:

  • Follow      all safety instructions.
  • Use      equipment responsibly.
  • Treat      other participants and staff respectfully.

9.2 In group Sessions, disruptive, unsafe, or inappropriate behaviour may result in removal from the Session without refund.

9.3 The PT reserves the right to terminate services where behaviour compromises safety or wellbeing.

10. Data Protection

10.1 Personal data will be processed in accordance with UK data protection legislation.

10.2 Information will only be used for delivering services, managing bookings, and related administration.

11. Amendments

The PT reserves the right to update these Terms & Conditions. Updated versions will be made available to Clients and will apply to future bookings.

12. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Personal Training Terms & Conditions

1. Definitions

“PT” refers to the Personal Trainer and/or Recreate Team.

“Client” refers to the individual receiving Personal Training services.

“Sessions” refers to one-to-one or group Personal Training sessions delivered by the PT.

2. Health & Medical Declaration

2.1 The Client confirms they are physically fit and have no medical condition that would prevent safe participation in exercise, or they have disclosed all relevant medical information prior to commencing training.

2.2 The Client agrees to complete a Physical Activity Readiness Questionnaire (PAR-Q) or equivalent health screening form before starting sessions.

2.3 The Client must inform the PT immediately of any injury, illness, pain, discomfort, or change in health status.

3. Assumption of Risk

3.1 The Client acknowledges that participation in physical exercise carries inherent risks, including but not limited to muscle strain, sprains, abnormal blood pressure responses, dizziness, heart disorders, or in rare cases serious injury.

3.2 By participating in training sessions, the Client voluntarily accepts and assumes all risks associated with exercise activities.

3.3 The PT will take reasonable care to provide safe instruction, supervision, and appropriate exercise programming; however, the Client understands that results cannot be guaranteed and participation is at their own risk.

4. Limitation of Liability

4.1 Nothing in these Terms & Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

4.2 Subject to clause 4.1, the PT shall not be liable for:

  • Injuries      sustained as a result of failure to disclose medical conditions.
  • Injuries      sustained outside of supervised sessions.
  • Indirect,      incidental, or consequential loss.

4.3 The PT’s total liability for any claim arising out of or in connection with the provision of services shall not exceed the total amount paid by the Client for the sessions giving rise to the claim.

5. Insurance

5.1 The PT confirms they maintain appropriate and valid insurance coverage, including:

  • Public      Liability Insurance
  • Professional      Indemnity Insurance
  • (Where      applicable) Employers’ Liability Insurance

5.2 Evidence of current insurance cover can be provided upon reasonable request.

6. Bookings & Cancellations

6.1 Sessions must be booked in advance and are subject to availability.

6.3 If the PT cancels a session, it will be rescheduled at a mutually convenient time or credited to the Client’s account.

7.1 Refunds are not provided for unused sessions except at the discretion of management or where required by law.

7.2 If a Client wishes to make a claim for a refund for any reason (including non-attendance, whether due to the Client’s fault or the PT’s fault), the claim must:

  • Be      made in writing
  • Be      sent to admin@recreateteam.com
  • Be      submitted no later than 14 days from the date of the incident

7.3 Refund claims submitted after 14 days from the incident will not be considered and will not be backdated under any circumstances.

9.1 The Client agrees to behave respectfully and follow all safety instructions given by the PT.

9.2 The PT reserves the right to terminate sessions without refund if the Client engages in unsafe, inappropriate, or abusive behaviour.

10. Data Protection

10.1 Personal information provided by the Client will be processed in accordance with applicable UK data protection legislation.

10.2 Information will only be used for the purposes of delivering training services and managing bookings and payments.

11. Amendments

The PT reserves the right to amend these Terms & Conditions at any time. Updated terms will be made available to Clients.

12. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.
